Lots of people here are talking about premiums. This reminds me of a true story. 36 years ago, California voters passed Proposition 103, an insurance reform initiative. Among other things, it rolled back the price rates on various types of insurance by 20%. My brother heard an insurance agent (his agent? I don't recall.) say, "if that [Prop 103] passes, we're going to have to pay claims out of premiums!"
You read that right - insurance companies do not willingly spend premiums. Their business model is to toss your pittance on top of their staggering mountain of money, and pay claims entirely out of investment income.
This doesn't always work out - sometimes they get caught with their pants down - but that's an insurance company's idea of how things ought to be.

So if the insurance company hires the lawyers for the purpose of defending the interests of the apartment complex, are the lawyers really the apartment complex's lawyers, or are they agents of the insurance company? I'm going with "B", because if the apartment complex said "I want different lawyers", I'm doubtful the insurance company would roll over on that. If they are agents of the insurance company, then couldn't it be argued the insurance company owns the bad acts of their agents?

I'm a big fan of free markets... for most things. Insurance is literally a textbook case of an industry where a market based approach, especially a capital centric one, is just not going to work. (Assuming "work" means producing a net benefit.).
The only reason insurance companies sort of work sometimes is that we regulate the hell out of them.
FWIW: Healthcare is another one of those cases where markets actually just make things worse.
