I actually met a guy selling his CDs in NYC at Times Square when I visited on a school trip in 2004. His name was Yorel and he actually still makes music, the CD was actually really good and had it in rotation for a long time until I lost the disc. So its a shame that people like this give all artists a bad name.

This happened to me in West Virginia of all places. I was on my last $20 and a guy approached me saying they were giving out CD’s of their cousin’s music who passed away, and that donations were accepted for his funeral. When I told him all I had was $20 he said “well there’s an ATM inside”.
I felt bad for the cousin who passed away and I am a musician myself so I went and got my last 20 and gave it to the guy. Popped in the CD and it was 10 tracks of complete silence.

I might not have explained it well enough, but they're literally selling you a QR code, which is just a link to an album on Apple Music. It's not an album download that you can keep. Without an Apple Music subscription, you can only listen to samples of the songs. The tourist gets nothing, and they probably feel pressured into tipping.
