The SEC is asking the court to decide in SEC v. Ripple that XRP, traded in the secondary public markets, is a security in violation of the Securities Act.
In the SEC v. KIK Interactive case, the parties filed cross-motions for summary judgment in March 2020. Their respective reply briefs to the oppositions were filed May 8, 2020. On June 18, 2020, the court in KIK ordered the parties to appear for oral argument on July 9, 2020. The court filed its order granting the SEC's motion and denying KIK's motion on September 30, 2020. For point of reference, there was one miscellaneous motion (asking for permission to submit video evidence) filed by the SEC after filing its reply brief in KIK case. The order denying the SEC's motion re video evidence was filed by the court on May 22, 2020 (KIK case). The SEC v. KIK case was filed in the Southern District of New York. Judge Hellerstein's individual rules state: "The Court will schedule the date and time for argument if it desires argument." Judge Torres's individual practices memorandum states: "The Court typically does not hold oral argument on motions, but it will notify counsel if oral argument is required." QUESTION: Do you think Judge Torres will order oral argument in the SEC v. Ripple case regarding the cross-motions for summary judgment? For reference, the parties in the Ripple case both filed additional authority letters in April and there has been several substantive motions since the parties filed their reply briefs.
