Should you be getting a Stamp Duty Refund from HMRC? Have you purchased a property in the last 24 months?

There are many reasons that landlords overpay Stamp Duty when purchasing a home or property investment.

- Uninhabitable properties are not residential properties for Stamp Duty purposes
- The 3% SDLT higher rate does not apply to first homes or when replacing a home
- Stamp Duty is not charged when transferring properties between husband/wife/family member when there is no change of debt or exchange of money
- Incorporating your property into a limited company
- Paying the incorrect amount when buying residential and commercial property in the same transaction (flat above a shop)
- Buying 6 or more residential properties, including bedsits
