**طلاق اور خلع کا مسئلہ: قرآن و حدیث کی روشنی میں تفصیل**
اسلامی شریعت نے نکاح کو ایک مضبوط اور مقدس بندھن قرار دیا ہے، لیکن اگر ازدواجی زندگی میں ایسی مشکلات پیدا ہو جائیں جو دونوں فریقین کے لیے ناقابل برداشت ہو جائیں، تو اسلام نے طلاق اور خلع کے ذریعے علیحدگی کا راستہ بھی فراہم کیا ہے۔
### **طلاق کی وضاحت**
طلاق کا حق مرد کو دیا گیا ہے اور یہ اس کی ذمہ داری ہے کہ وہ اس حق کو انتہائی دانشمندی اور تحمل سے استعمال کرے۔ قرآن مجید میں طلاق کے متعلق واضح ہدایات موجود ہیں:
1. **قرآن مجید میں طلاق کی وضاحت:**
اللہ تعالیٰ فرماتے ہیں:
> "طلاق دو بار ہے، پھر یا تو حسن سلوک کے ساتھ روک لینا یا بھلے طریقے سے رخصت کر دینا۔"
(سورہ البقرہ: 229)
یہ آیت طلاق کے اصولی طریقہ کار کو بیان کرتی ہے کہ طلاق دو مرتبہ دی جا سکتی ہے، اور اگر اس کے بعد مصالحت نہ ہو تو علیحدگی کا حتمی فیصلہ لیا جا سکتا ہے۔
2. **عدت کی مدت:**
> "اور طلاق یافتہ عورتیں اپنے آپ کو تین حیض تک روکے رکھیں۔"
(سورہ البقرہ: 228)
یہ آیت عورت کے لیے عدت کی مدت مقرر کرتی ہے تاکہ دوبارہ نکاح یا مصالحت کے لیے وقت مل سکے۔
### **خلع کی وضاحت**
خلع وہ عمل ہے جس میں عورت شوہر سے طلاق طلب کرتی ہے، اور اس کے عوض کچھ مالی یا دیگر معاہدے طے پاتے ہیں۔ یہ عورت کا حق ہے اگر وہ شوہر کے ساتھ زندگی گزارنے سے معذور ہو۔
1. **قرآن میں خلع کا ذکر:**
> "اگر تم ڈرو کہ وہ دونوں اللہ کی حدود کو قائم نہ رکھ سکیں گے، تو عورت کچھ مال دے کر علیحدگی کر سکتی ہے۔"
(سورہ البقرہ: 229)
یہ آیت خلع کے جواز کو واضح کرتی ہے کہ اگر زوجین کے درمیان تعلقات مزید برقرار نہ رہ سکیں، تو خلع ایک مناسب حل ہے۔
2. **حدیث میں خلع:**
رسول اللہ ﷺ نے ایک صحابیہ (حضرت جمیلہؓ) کے بارے میں فرمایا، جنہوں نے اپنے شوہر سے خلع طلب کیا:
> "رسول اللہ ﷺ نے ان سے (مہر کے طور پر دیا گیا) باغ واپس دلوا کر ان کا خلع کر دیا۔"
(صحیح بخاری: 5273)
### **اختتامیہ**
اسلامی تعلیمات طلاق اور خلع کے مسائل کو حل کرنے کے لیے ایک متوازن اور انصاف پر مبنی نظام فراہم کرتی ہیں۔ یہ عمل آخری حل کے طور پر اختیار کرنا چاہیے، اور دونوں فریقین کو صبر، حکمت اور عدل کے ساتھ فیصلہ کرنا چاہیے۔
**یہ تمام ہدایات اس بات کا ثبوت ہیں کہ اسلام میں ازدواجی مسائل کے حل کے لیے واضح اور جامع رہنمائی موجود ہے۔**
**The Issue of Divorce and Khula: Explanation in the Light of the Quran and Hadith**
Islam considers marriage a sacred and strong bond. However, if marital life becomes unbearable due to irreconcilable differences, Islam provides the solutions of **divorce (Talaq)** and **Khula** to ensure justice and peace for both parties.

### **Divorce (Talaq)**
Divorce is a right given to the husband in Islam, and he is expected to exercise this right with wisdom and patience. The Quran provides clear guidance on the process of divorce:
1. **The Quran on Divorce**
Allah says:
> **“Divorce is twice; then, either keep [her] in an acceptable manner or release [her] with good treatment.”**
(Surah Al-Baqarah: 229)
This verse explains that divorce can be pronounced twice, and after that, the decision to reconcile or separate must be made wisely.
2. **Waiting Period (Iddah):**
> **“And divorced women shall wait [as regards their marriage] for three menstrual periods.”**
(Surah Al-Baqarah: 228)
This waiting period allows time for possible reconciliation or preparing for new decisions in life.

### **Khula (Wife-Initiated Separation)**
Khula is a process where a wife seeks separation from her husband, often by returning the dower (Mahr) or through mutual agreement. It is her right if living with her husband becomes unbearable.
1. **The Quran on Khula**
> **“If you fear that they will not be able to keep within the limits of Allah, then there is no sin upon either of them if the woman gives something for her release.”**
(Surah Al-Baqarah: 229)
This verse validates Khula as a solution when mutual agreement is impossible.
2. **Hadith on Khula**
The Prophet Muhammad ﷺ approved Khula in the case of Jameela bint Ubayd, who sought separation from her husband.
> **“The Prophet ﷺ ordered her to return the garden (given as Mahr) and granted her Khula.”**
(Sahih Bukhari: 5273)

Oaths and Expiation: Evidence from the Quran and Hadith
Quranic Teachings on Oaths and Expiation:
Allah has provided clear guidance on oaths and their expiation in the Quran. In Surah Al-Ma’idah, Allah says:
"Allah will not impose blame upon you for what is meaningless in your oaths, but He will impose blame upon you for [breaking] what you intended of oaths. So its expiation is the feeding of ten needy people from the average [food] that you feed your own families, or clothing them, or the freeing of a slave. But whoever cannot find [or afford it] – then a fast of three days [is required]. That is the expiation for oaths when you have sworn. But guard your oaths. Thus does Allah make clear to you His verses that you may be grateful."
(Surah Al-Ma’idah: 89)
Prophetic Teachings on Oaths and Expiation:
Abdullah ibn Umar (may Allah be pleased with him) reported that the Prophet Muhammad (peace be upon him) said:
"Whoever swears an oath and later sees that something else is better, let him do what is better and offer expiation for his oath."
(Sahih Bukhari: 6622, Sahih Muslim: 1649)
Explanation of Oaths and Expiation:
Meaning of an Oath:
An oath is a solemn pledge made in the name of Allah to affirm or commit to something. It must be made with deliberate intention.
If an oath is taken carelessly or without intent, it is considered a "vain oath," for which no expiation is required, as stated in the Quran.
When is Expiation Necessary?
Expiation becomes mandatory when one deliberately breaks an oath that was intended to be fulfilled.
The Quran outlines three ways to expiate for a broken oath:
Feeding ten needy people with food of average quality.
Clothing ten needy individuals.
Freeing a slave.
If none of these is possible, fasting for three consecutive days is prescribed.
Permissibility of Breaking an Oath:
According to the Hadith, if fulfilling an oath would result in harm or if breaking it leads to a better course of action, it is permissible to break the oath. However, expiation must be offered.
Conclusion:
Fulfilling oaths is a serious matter in Islam. However, if breaking an oath leads to a greater benefit or avoids harm, it is permissible to do so by offering the prescribed expiation. These teachings from the Quran and Hadith highlight the importance of balancing personal accountability with the greater good and social welfare.
قسم اور کفارہ: قرآن و حدیث کی روشنی میں دلائل
قرآن مجید میں قسم اور کفارہ کے احکامات:
اللہ تعالیٰ نے قرآن پاک میں قسم اور اس کے کفارے کے متعلق واضح احکام دیے ہیں۔ سورہ المائدہ میں ارشاد ہوتا ہے:
"لَا يُؤَاخِذُكُمُ اللَّهُ بِاللَّغْوِ فِي أَيْمَانِكُمْ وَلَكِنْ يُؤَاخِذُكُمْ بِمَا عَقَّدْتُمُ الْأَيْمَانَ ۖ فَكَفَّارَتُهُ إِطْعَامُ عَشَرَةِ مَسَاكِينَ مِنْ أَوْسَطِ مَا تُطْعِمُونَ أَهْلِيكُمْ أَوْ كِسْوَتُهُمْ أَوْ تَحْرِيرُ رَقَبَةٍ ۖ فَمَنْ لَمْ يَجِدْ فَصِيَامُ ثَلَاثَةِ أَيَّامٍ ۚ ذَٰلِكَ كَفَّارَةُ أَيْمَانِكُمْ إِذَا حَلَفْتُمْ ۖ وَاحْفَظُوا أَيْمَانَكُمْ ۚ كَذَٰلِكَ يُبَيِّنُ اللَّهُ لَكُمْ آيَاتِهِ لَعَلَّكُمْ تَشْكُرُونَ"
(سورۃ المائدہ: 89)
ترجمہ:
"اللہ تم سے تمہاری بے مقصد قسموں پر مواخذہ نہیں کرے گا، لیکن وہ تم سے ان قسموں کا مواخذہ کرے گا جن کو تم نے مضبوطی سے باندھا ہے۔ تو اس کا کفارہ دس مساکین کو کھانا کھلانا ہے جو تم اپنے اہل و عیال کو کھلاتے ہو، یا ان کو کپڑے دینا، یا ایک غلام آزاد کرنا۔ اور جس کو یہ میسر نہ ہو تو تین دن کے روزے رکھے۔ یہ تمہاری قسموں کا کفارہ ہے جب تم قسم کھاؤ۔ اور اپنی قسموں کا خیال رکھو۔ اللہ تمہارے لیے اپنی آیات یوں کھول کر بیان کرتا ہے تاکہ تم شکر گزار بنو۔"
حدیث میں قسم اور کفارے کے متعلق تعلیمات:
حضرت عبداللہ بن عمر رضی اللہ عنہ سے روایت ہے کہ رسول اللہ ﷺ نے فرمایا:
"جو شخص قسم کھائے اور دیکھے کہ اس کے علاوہ بہتر کام ہے، تو وہ اپنی قسم کا کفارہ دے اور وہ بہتر کام کرے۔"
(صحیح بخاری: 6622، صحیح مسلم: 1649)
قسم اور کفارہ کی وضاحت:
قسم کا مطلب:
قسم کا مطلب ہے کسی بات پر اللہ تعالیٰ کو گواہ بنا کر کوئی وعدہ یا دعویٰ کرنا۔ یہ عزم اور نیت کے ساتھ کی جاتی ہے۔
اگر کوئی غلطی سے یا بے مقصد قسم کھا لے تو اس کا کوئی کفارہ نہیں، جیسا کہ قرآن کہتا ہے، "لغو قسموں پر مواخذہ نہیں۔"
کفارہ کب لازم ہوتا ہے؟
جب کوئی قسم پوری نہ کرے جس کا ارادہ کیا تھا۔
کفارہ دینے کے تین طریقے ہیں:
دس مساکین کو کھانا کھلانا۔
دس مساکین کو کپڑے دینا۔
ایک غلام آزاد کرنا۔
اگر یہ ممکن نہ ہو تو تین دن کے روزے رکھے جائیں۔
قسم توڑنے کی اجازت:
حدیث کی روشنی میں اگر قسم کسی غلط یا نقصان دہ بات پر ہو اور اسے توڑنے میں بہتری ہو، تو کفارہ دے کر قسم توڑنی جائز ہے۔
نتیجہ:
قسم کو پورا کرنا اسلام میں اہم ہے، لیکن اگر بہتر عمل کے لیے قسم توڑنا ضروری ہو، تو کفارہ ادا کر کے توڑنے کی اجازت دی گئی ہے۔ قرآن و حدیث کی ان تعلیمات سے واضح ہوتا ہے کہ اسلام میں عملی فائدے اور سماجی انصاف کو ترجیح دی جاتی ہے۔
