A statement considering an accusation by another YouTuber called @GIOBOZZwho made a rather scathing video about me.
As of this morning, I issued a video take-down request for two reaction videos that he had made on my videos on his channel. Both of his videos were created without any regard to YouTube's fair use policies or Finnish copyright law. GIO BOZZ has hidden my original response/comment in his video so I wanted to copy and paste it hear.
Below is an exact copy of my reply to some of the claims that he makes in his video 👇
______________________________________________________________________________________________________
A few clarifications of what was stated in his (GIO BOZZ's) video:
1. I did not accuse you of intentionally hiding your video from the YouTube Content ID system. This is absolutely false and your own interpretation of what happened. What I meant is that your video did not show in the YouTube Content ID system and I suspected that it was because of the crop. For those who do not know what the Content ID system is, it is a tool in the YouTube creator studio that recognises if someone is using significant portions of a video that you have uploaded on your own channel (in this case mine). The Content ID system is really good at finding "duplicate content" on the platform so that people can issue Copyright claims (meaning that the ad income will go to the original content owner – e.g. a music artist) or video take-down requests (meaning that YouTube will prompt the creator using copyrighted material to delete their video or reply to the request within 7 days – if not, they will get a Copyright Strike) but in this case, I did not get any notifications from the Content ID system. Instead, GIO BOZZ's video was pointed out to me by someone I know.
2. Your explanation of "paying for the music for the same person" is either just a clear misunderstanding of how copyright works, or an outright lie. For those who are interested, I license and pay for all music on my channel through Epidemic Sound. It is a subscription service that allows content creators to use music copyright free for a monthly fee. I have not paid any individual artist that GIO BOZZ could "partner with". Even so, if I had paid for the individual artist that you work with or have paid, it does not make any difference. Music licenses are issued individually and you have no right to use videos with music, or other material for that matter, that I have paid for on my channel.
3. Having a copyright "disclaimer" literally means nothing. This is a few lines of text that people who do not understand copyright law use on social media because they think that it makes it okay to use other people's material. This is a common mistake and it has absolutely no meaning what so ever as it comes to actual copyright laws or rights. I would also note here to those who do not know, fair use is often claimed by reaction channels as a legal argument for using copyrighted material. Fair use is a US law that has nothing to do with Finnish or European copyright law. YouTube mentions this clearly on their own "fair use" page and prompts creators to adhere to local copyright laws depending on their situation: support.google.com/youtube/answer/9783148?hl=en
4. So you accuse me of being greedy because I am protecting copyrighted material that I have paid for and/or created? This is literally how copyright law works! You pay a licensing fee (or in this case your YouTube ad revenue) to the original artist for permission to use their material So who is the greedy party here – the one creating original content and paying for its creation – or the person who uses other people's content for free to make money? Your argument is patently absurd.
5. Finally, what GIO BOZZ is not stating here at all is that once he replied to me via email and noted that he had a link to my video in his description, I apologised for the mistake. Clearly he does not want to mention this because he wanted a villain that is evil and racist. Having said this, having a link to the original video is not even the problem here – the issue is that GIO BOZZ is not abiding by "fair use" practices (which are guidelines for copyright law in the US and have nothing to do with copyright law in Europe or Finland) nor the Finnish copyright laws, which are much stricter. These are the rules that everyone on social media have to abide by and now he is accusing me of greed for simply using the tools given to us by YouTube to protect our own content.
