I ended up bringing back Tim Skywalker for another animated bumper for TRG Colosseum 2023. The full bumper is now available on Ben's channel in the link below along with credits to everyone else who worked on it!

So in the weeks since my last post, there have been statements released by the FTC and now YouTube.

A couple of weeks ago, the FTC released a ā€œclarificationā€ on their website which cleared up some things, but at the same time, they still continued to remain too vague for my liking and many of their ā€œsuggestionsā€ for helping us were next to useless.

Fast forward to today where YouTube finally came out and answered several of the most critical questions everyone has been asking. Admittedly, yes, most of their answers were literally just read straight from the FTCā€™s website (almost word-for-word in some cases). But compared to the near-nothing that was given with just the FTC update alone, the clarification of the labels ā€œFor Kidsā€ and ā€œNot For Kidsā€ and how they are each viewed easily provided the most assurance out of anything else.

Thereā€™s a bit more than just that but I donā€™t want this post to go on like an essay like my previous one (I thought about making an update video but December is always a busy month for me and Iā€™m not sure about doing a voice-reveal on YouTube just yet).

Long story short, the last few weeks have been... a series of ups and downs ever since this all went down (I use YouTube for school and other things after all, not just as a hobby). Thereā€™s still a chance this could all go south but it seems far less likely now.

Anyways, Iā€™ve decided to rethink my plans to delete my videos now that most of the air has been cleared. However, this does not mean that I will stop uploading my animations to other sites like Newgrounds jolivector.newgrounds.com/ . Until this all went down, I never realized that Iā€™ve been putting my eggs in one basket (I use these animations for portfolio purposes as well after all). Iā€™m also sticking to my statement in my previous post that Iā€™ll be focusing on smaller projects among other things that Iā€™ve been meaning to get around to. So Animatedā€™s here might be shorter or farther in between moving forward. Thank you everybody.

Hello everyone. By now Iā€™m sure a lot of you are aware of someā€¦ scary, legal changes coming to YouTube courtesy of the FTC.


For those who are unaware of whatā€™s going on, there are a few articles and other YouTubers that can explain the situation better than I ever could but long story short, all channels are now required to mark their videos as ā€œMade For Kidsā€ or ā€œMade For Adultsā€ and if you mark it wrong the FTC could sue you for $42,000 per video that was incorrectly markedā€¦ yeah, YOU not YouTubeā€¦ and PER videoā€¦ which makes no sense because this whole thing started because YouTube was collecting and using data from kids, but weā€™re NOT the ones collecting this data.


The FTC has a list of things that could be seen as Made For Kids and among them was ā€œWhether the video includes characters, celebrities, or toys that appeal to children, including animated characters or cartoon figures.ā€ This creates an extremely dangerous minefield for animation, toys, and even gaming channels who do not make content targeted towards children or at any specific age group. Itā€™s an extremely gray area and the COPPA guidelines do not account for it.


So hereā€™s the gist of it: If you mark your video as ā€œNot For Kidsā€ and it even REMOTELY looks like something kids would watch (at least according to the FTC) youā€™re at risk since these videos will track user data. So no, setting your videos to ā€œNot For Kidsā€ does not save you, itā€™s actually what puts you in the crosshairs in the first place. Even if youā€™re absolutely confident you picked the right label for your video, thereā€™s still a good chance that the FTC will disagree and youā€™re in trouble. It all comes down to the fact that the videos will be looked at by the FTC, people who are not really familiar with internet culture or even know what kids and adults actually like, and they will be the ones to decide if the video is for kids or for adults and they will likely only look at the videos on the surface level.


So what if you mark your videos as ā€œFor Kids?ā€ Well, those videos will not have a comment section, end screens (which I use), video cards, among other things, as well as no personalized ads so thereā€™s less money flowing from it. They also will not be shown in the Recommended feed or appear in searchesā€¦ basically they are erased from existence and the only way to see those videos is by going to the actual channel and clicking on it from there, essentially killing the video upon upload.


So if you mark your video as ā€œFor Adultsā€ your at risk of being fined if the FTC disagrees, and if you set it as ā€œFor Kidsā€ no oneā€™s going to be able to see it and youā€™ll make nothing from it.


The whole issue is that the language they use in their guidelines is too vague. Thereā€™s a chance that this does not apply to legitimately innocent channels and only targets actual predatory channels, but none of that is specified and the current wording and language leaves too many questions and encompasses most content on YouTube so no one knows whoā€™s safe, especially in the animation community. It also doesnā€™t help that the FTC described this as ā€œshooting fish in a barrelā€ and in such a vindictive toneā€¦


Yeahā€¦ it goes without saying that this whole situation is completely dumbā€¦


As an animator myself, Iā€™m sure you all know that my animations are relatively clean but do have plenty of occasional swearing and Iā€™m not opposed to making some bloody scenes (I just happened to have no need for any so far). So my work is mostly PG or PG-13, which means I fall in that gray area of complete uncertainty because my videos will most likely be evaluated purely on the surface level, as the FTC will likely do, regardless of context.


So with that said, as a precaution I will delete all of my videos on the channel (it turns out setting them to Private or Unlisted wonā€™t save you) sometime in mid-December before the changes take place and I probably wonā€™t be uploading here for quite some time, or ever, until this situation is resolved. I will still be active on other platforms, just not here on YouTube. Donā€™t worry, I still have the files for all of my animations. I just need to find a new home for them. I have thought about setting the videos to ā€œFor Kidsā€ but we donā€™t know if the fines will also apply to mislabeling an adult/general video as ā€œFor Kidsā€ as well (again, nothing is clear and everything is generalized).


With any luck the situation will resolve itself soon, or be delayed, or it turns out to not be as bad as we think, and all of these precautions Iā€™m taking will be for nothing, and I donā€™t mind reuploading all of my stuff once everything clears up. But right now, as of this writing, even uploading a video presents too great a risk, one I simply cannot afford to take (lawyers are expensive and the fines would ruin me financially).


Until I settle on a new home for my animations or return here, Iā€™m going to be focusing more on smaller projects like the ones I occasionally upload to Instagram and Twitter, and other things Iā€™ve been meaning to get around to outside of YouTube. So I may not be doing full Animatedā€™s for some time. I wonā€™t be deleting the entire channel since thereā€™s a chance I might return. Iā€™ll still be using it during the hiatus but mostly for commenting on videos and stuff, so you might still see me floating around every now and then.
