GST Decision by HIGH COURT OF CALCUTTA
HC Allows Manual Resubmission of Corrected GSTR-1 Due to Inadvertent IGST Error on Export Invoices
Facts: The petitioner mistakenly marked exports as without payment of IGST instead of with payment of IGST in GSTR-1 for October and November 2022, while GSTR-3B reflected the correct details. The petitioner sought to rectify the mistake after a partial refund was granted but was unable to access the GST portal for corrections. Customs and State authorities confirmed the mistake but lacked control over the portal to allow the correction.
Decision: The court allowed the petitioner to manually resubmit the corrected GSTR-1 within three weeks. The GST authorities were directed to receive the corrected form manually and facilitate its uploading on the portal. The petitioner should not be prejudiced from availing legitimately entitled credit due to a genuine mistake.

Question: What is the difference between for IMS Inward Supplies vs IMS Outward Supplies?
Answer: Mr. Ramlal have 10 Invoices for his inward supplies and there are 5 Invoices for Ramlal Outward Supply. In such a case.
If Mr. Ramlal wants to check whether supplier of Mr. Ramlal shown these 10 invoices correctly then he will check IMS for Inward Supplies.
Question : IMS is Mandatory or Optional?
Answer: IMS is Optional, but there are certain cases in which IMS in Mandatory
Ex:- Suppose Mr. Ramu purchased some goods from deepak in the month of September 2024, Invoices has been properly shown by deepak in his gstr-1, and if Mr. Ramu does not file his IMS then ITC will be automatically shown his GSTR-3B. In next month Mr. Deepak Issued a Credit note against above invoice in such a case, Mr. Ramu have to accept or reject that credit note.
So from above example IMS is Optional in the month of October but it is mendatory in the month of November. But this is advisable to you, kindly use IMS System for correct ITC in every month.

The Central Board of Direct Taxes (CBDT), under section 119 of the Income-tax Act, 1961 ('the Act'), has extended the due date for furnishing the Return of Income under sub-section (1) of section 139 of the Act for Assessment Year 2024-25. For assessees covered under clause (a) of Explanation 2 to sub-section (1) of section 139, the deadline has been extended from 31st October 2024 to 15th November 2024.
