SHOCKING: A new report from the Washington Free Beacon has found that snitch hotlines for protected speech operate in seven states and five localities, including Philadelphia. Citizens are now encouraged to report non-criminal speech to the police.
This is America. We donât play Big Brother with protected speech.
Even more concerning is that itâs unclear what some states and localities do with these reports. The fear of ending up in a government database just for saying something that upset or offended another person will reliably lead people to self-censor.
And while often anonymous, localities like Philadelphia and West Chester Co. ask for âoffenderâ names, too. Thatâs right: the birthplace of American democracy now wants to play Big Brother for people offended by protected speech.
These systems, which include hotlines and online portals, resemble the bias response teams commonplace on college campuses, which allow students to report each other anonymously and without verification.
Letâs be clear about one thing: Leaning on surveillance, snitch lines, and sensitivity training to intimidate the public into submission defies the principles of free speech upon which this nation was founded.
âExporting campus bias reporting systems to wider society is a disastrous idea,â said FIREâs Aaron Terr. âWhen a state policy explicitly calls out âoffensive jokes,â itâs past time to worry.â
This shows that what happens on campus doesn't stay on campus.

BREAKING! The Supreme Court today ruled that a federal law compelling TikTokâs parent company, ByteDance, to sell the social media site or cease operations in the United States does not violate the First Amendment. The law functionally requires TikTok to shut down its operations by Jan. 19 absent some other accommodation.
FIRE issued the following statement:
Our unique national commitment to freedom of expression requires more caution than todayâs ruling delivers. The unprecedented ban of a communication platform used by 170 million Americans demands strict judicial scrutiny, not the rushed and highly deferential review the Supreme Court instead conducted.
The Court explicitly notes the âinherent narrownessâ of todayâs decision. FIRE will hold it to that promise, and fight to contain the threat the ruling poses to our First Amendment rights.

West Virginia Gov. Patrick Morrisey issued an executive order yesterday to eliminate certain diversity, equity, and inclusion (DEI) practices in state agencies and organizations that receive state money. While the state may limit certain programs or activities of state agencies, the executive order is written so broadly that it applies to classroom instruction in higher education. As such, the executive order violates the First Amendment and must be rescinded or amended to make clear that it does not affect whatâs discussed in college classrooms. If the order is not rescinded or amended, West Virginiaâs public institutions must protect faculty academic freedom rights and make sure that classroom teaching is not affected.

BREAKING: Yesterday, a federal judge struck down the Biden administrationâs unconstitutional Title IX rules. This is a huge victory for free speech and due process on campus.
In 2024, the Department of Education finalized new rules that FIRE criticized for eviscerating student due process rights and mandating a new, speech-restrictive definition of student-on-student harassment.
The invalidated rules violated studentâs basic due process rights in many ways. They:
đeliminated the right to a live hearing to contest allegations
đeliminated the right to cross-examine oneâs accuser and witnesses
đweakened the right to be represented by lawyers in campus sexual misconduct expulsion proceedings
đallowed for the return of the âsingle-investigatorâ model, in which a single administrator serves as prosecutor, judge, and jury
In the opinion, the court echoed FIREâs longstanding argument: The Education Departmentâs definition of sexual harassment doesnât follow Supreme Court precedent. The judge also found that the 2024 regulations violated the First Amendment.
As the court said: âPut simply, the First Amendment does not permit the government to chill speech or compel affirmance of a belief with which the speaker disagrees in this manner.â

BREAKING: FIRE will defend J. Ann Selzer, the veteran pollster whose last poll before the 2024 election incorrectly predicted Vice President Kamala Harris leading in Iowa, against a baseless lawsuit by President-elect Donald Trump that threatens Americansâ First Amendment rights.
Trumpâs lawsuit claims Selzerâs poll constitutes âconsumer fraud.â That is not what those words mean. Consumer fraud laws are about the scam artist who rolls back the odometer on a used car, not a newspaper pollster whose prediction of an election winner doesnât pan out.
Selzer used the same methodology as when she previously called the state for Trump in 2016 and 2020, but this time she got it wrong. After Election Day, she released the full results of her telephone survey along with the weighting system used to interpret the data.
Selzer adds: âThe response to a mismatch between my final poll and the decisions Iowa voters made should be thoughtful analysis and introspection. I should be devoting my time to that and not to a vengeful lawsuit from someone with enormous power and assets.â
This is America. No one should be afraid to predict the outcome of an election. Thatâs why we refuse to let Donald Trump abuse the legal system to punish Selzer for speech he dislikes.
