Is there a need for a Freelance Contract?
I am not lawyer to make you aware of legal matters, but I’m answering some common questions I know about freelance contracts, including whether or not you need one (spoiler alert: you do) and what your contract should include.
⚠️Question 1
Is it needed for every single client and project?
YES!
The contract contains the rules that you and your client has to abide by. It is a legally-binding document that worth more than chats and emails. The benefit is that it protects you both.

What are mandatory components of your Freelance Contract?
Your contract must have the following sections:
✓Introduction
✓Services to be performed
✓Payment
✓Terms of Agreement
✓Independent Contractor Status
✓Intellectual Property Rights
✓ Indemnification and limitation of liability
✓Confidentiality
✓Force Majeure
✓Termination of Agreement

When do you need to send the Freelance Contract?
Before you start working on the project (Definitely!!)

If your client sends you a contract, then do you have to send yours too?
NO! (You cannot have 2 different contracts for the same task with different conditions)

What is the role of Intellectual Property in your Freelance Contract?
There are 2 types of languages used in contracts for IP rights.
1. Work for Hire (The client has right to do anything with the work you do for them)
2. License (You own the work you do. The client has exclusive or limited access based on the contract.)
Usually "Work for Hire" is the commonest among all the freelancers.

Can the client request changes in the contract, and vice versa?
Both of you will have to sign a "Contract Amendment" (A separate document that states the changes in the original contract)

What if the client refuses to sign the contract?
As long as all the terms on the contract are fair and reasonable, then it is a red flag. Leave the client. Say Goodbye & wish him well.
⚠️Question 8
Can you get out of the contract?
YES, but you need to be aware of the rules of termination in a proper way.
It is worth having a contract than to work for a client who wouldn't guarantee your rights otherwise.

ایک سادہ لوح آدمی کو یہ شرح سود بہت کم لگے گی لیکن یہ ایک ٹریپ ہے۔ یاد رکھیے کہ مالیات کی دنیا میں شرح سود ہمیشہ سالانہ ہوتی ہے۔ اگر کوئی ماہانہ یا روزانہ کی بنیاد پر شرح سود بتا رہا ہے تو اصل شرح سود دکھائی دینے والی شرح سود سے بہت زیادہ ہو گی۔
زیادہ پیچیدگی میں جائے بغیر ، اس وقت عام بینک سالانہ کنزیومر لون پر کوئی %25 کے قریب شرح سود رکھے ہوئے ہیں۔ چونکہ کمپاؤننڈنگ روزانہ کی بنیاد پر ہے اس لیے اصل میں آپ کو سال میں کوئ %28 سود دینا پڑتا ہے۔ اس کا مطلب ہے کہ اگر آپ نے ایک لاکھ قرضہ لیا تو سال بعد آپ 128,000 روپے بینک کو دینے کے پابند ہوں گے۔
اس کے مقابلے میں یہ "آسان" قرضہ سکیم پر نظر کیجیے۔ اگر روزانہ کا سود الگ لگایا جائے تو ایک لاکھ روپے کے بدلے %0.8 کا مطلب ہے روز کے 800 روپے اور سال بھر میں صرف سود کی مد میں رقم 292,000 بن جائے گی یعنی ایک سال بعد ادا کی جانے والی رقم 392,000 ہو گی۔ سود کی شرح %292
اگر واقعی کسی "خوش قسمت" کو %0.3 پر بھی قرضہ ملے تو بھی افیکٹو شرح سود %109 ہو گی یعنی سال بعد 100,000 کے بدلے 209,000 کی واپسی
اور کہیں %0.8 روزانہ پر سود مرکب لگے تو پھر آپ سوچ بھی نہیں سکتے کہ سود کہاں جائے گا۔ سود مرکب کا فارمولا یہ کہتا ہے کہ یہ شرح %1732 ہو جائے گی۔ اس لیے ہم اسے ایک طرف رکھ دیتے ہیں۔ گرچہ کم مدتی قرضوں پر بعید نہیں کہ یہ شرح لگا کر سود وصول کیا جائے۔ یعنی ایک روپے پر سالانہ 1732 روپے۔
سو مختصر موازنہ یہ رہا۔۔
بینک کی سالانہ شرح سود %25
بینک کی افیکٹو شرح سود %28
ایپ کی روزانہ شرح سود %0.8
ایپ کی افیکٹو شرح سود %292
