In a landmark observation, the Supreme Court of India has declared that daughters have an āindefeasible, legally enforceable, and legitimate rightā to secure educational expenses from their parents.
This right ensures that daughters, irrespective of family circumstances, can demand financial support for their education, within the means of the parents.
"She, being the daughter, has a fundamental right to pursue her education, for which the parents could be compelled to provide necessary funds within the limit of their financial resources," the court stated.
This observation was made during a case involving an estranged couple and their daughter, who is pursuing higher education in Ireland.
The bench, comprising Justices Surya Kant and Ujjal Bhuyan, emphasised the importance of education as a fundamental right for every individual.
