You have the option to buy at the price you offered but are under no obligation or contractual agreement to follow through with it. My understanding is it's a way to protect buyers from getting screwed if there is something seriously wrong with the house. But it's instead being used as a loophole to seal the winning offer.

Trial lawyers got paid HUGE! (Most importantly) Buyers, especially low income earners, just got hosed. Now they either pay for agent representation (either a RE agent or RE atty) out of pocket, up front, OR they can bend over and get "Dual Agency" pounded. This lawsuit was never about saving the consumer $$$.

I purchased a house roughly 1.6 years ago that was bigger for my family. The problem is it's too big (2 story) and we prefer a house with a pool. Due to mortgage rates rising I got scared and jumped in a new house. I paid 520k for it as an FSBO and close in around 30 days.

The auctioneer is just a way to keep the score. It would've been fine if house 3 were last on the auction order but houses 1 & 2 were next to go. Once the auctioneer revealed the reserve for house 3, than everyone knew what the reserves were for the other 2. House 1 would've made way more if they went 2nd.
