I like how Miyamoto isn't portrayed as an evil villian, but rather a fun guy who likes making games and likes hearing others out. He cares about Mario alot, seeing how he was going to let him and Luigi out of prison in a heartbeat, and was sad to see them in a way he thought was like a disease

Edit: I know they’d get sued, but that’s if they did it without licensing. If they did get a license (which would be difficult to get) then it would be possible, but it’s probably not worth the legal procedures and time that it would have to go through.
