Literally everybody has done this. Yes, it's not smart to do, and avoid at all costs (bring correct equipment for the job). But there'll be that one instance where it's necessary to do so, just be extremely careful.

Hes in the tbar which he can steady himself on. I hate that stupid rule. Stand on the top of the ladder who cares. Just don’t be unstable on a ladder in general and you’ll be fine. It’s common sense

Its safer and you have more balance on the top step than you do on the next step down, try to lean your shins on the top step for leverage and over teaching most of the time, this is actually safer. And if you can't do this safely you probably can't do much safely so maybe go ride a desk for a living. Also if you lose your ballance this way you have less of a chance of getting tied up in the ladder, you can simply step off or kick the ladder out of the way so your not coming down on it. You lose balance on one of the lower steps your going down with the ship.

That cap isn't rated for the same weight as the rest of the ladder and will fail. Don't be cheap or lazy when it comes to your safety.
