Case Update: LALIT KUMAR MODI v. BCCI
The Supreme Court on June 30, 2025, dismissed ex-IPL Chairman Lalit Modi's writ petition seeking βΉ10.65 crore indemnification from the Board of Control for Cricket in India (BCCI) for a FEMA penalty imposed by the Enforcement Directorate.
π§Ύ The Court observed that BCCI is not a "State" under Article 12 of the Constitution, and thus a writ under Article 226 is not maintainable in this context. Modi had invoked Rule 34 of the BCCI Constitution, which allows reimbursement for legal liabilities incurred in official capacity. But both the Bombay High Court and the Supreme Court found the claim "misconceived."
π¨ββοΈ Justices PS Narasimha and R Mahadevan noted that Modi can still pursue a civil suit to claim indemnity if legally justified.

βοΈ What This Means: This case reinforces the legal position that private sports bodies like BCCI are outside the direct writ jurisdiction, unless performing public functions. It also opens up debate on equal treatment among ex-office bearers regarding indemnity claims.
