I was on the M61 southbound last night and the gantry signs said “M60 south exit closed”. So I diverted myself and went through Salford. It wasn’t closed. Made me look stupid to my customers behind me.

As for Smart motorway signs showing 50mph at 3am with next to no traffic, well that’s for another bugbear.

The law would say that the 50 limit still applies. Under Section 86 of the Road Traffic Regulation Act 1984, there would be a temporary traffic regulation order in place mandating the 50 limit, which would supersede the variable speed limit order for that section of road.

Whilst that is the strict legal standpoint, you would likely have a defence under s.85 RTRA, as confirmed by the courts. In Wawrzynczyk v CC Staffordshire (The Times 16th March 2000) the court observed that the purpose of section 85 is that adequate guidance is given to motorists. The objective of the section is that motorists should not be convicted in the absence of adequate guidance. Therefore, a court could rightly determine that the speed limit was ambiguous on this section of road and find in your favour.

Surely depends on the car? If you're in an audi or BMW then you don't care about such menial things as speed limits. In reality though you can see that the 50 continues up the of slip. And the cones come to an end on the main carriageway. The average cameras will catch you if your AVERAGE speed in the temporary section is higher. Not all the average cameras are on all the time. But after them your good to go. It's where dash cams are so useful.

this is the norm now. you would need camera proof. police closed lane 1 on a motorway while a red x on lane 2 and 3 was in place the speed camera was flashing like a maniac.

I would say from a legal standpoint it can be argued that ambiguity is on the drivers side. Provided there is evidence to back up the ambiguity. However it was clearly in a roadworks area with narrow lanes so being cautious and remaining at 50 would be the safer thing to do.

Clearly the short stretch to between the temporary sign and the electronic sign is a 50 limit, after the electronic sign the limit increases to 60.

This happened to me on the M6 the other week. Temporary speed limit set to 50 through the roadworks & the next gantry was showing 60mph followed by a NSL & then down to 40mph. All this was within 3 gantries after the roadwork 50 sign. Deliberate attempt to get speeding fines revenue or just incompetence?

I'd base it on the road and traffic conditions and speed of other traffic to decide which one. Then make sure I saved the dashcam footage to dispute the ticket that I was under the limit according to the most recent sign passed!

Did you notice the average speed yellow cameras on left ? They will measure 50 average on the section of temporary reduced 50 zone.

I saw something like that when me and my mum were going to east mids airport. The smart motorway signs changed right from a 40 to a 50 as we passed so everyone in front was doing 40, they were removing the smart-lessness from the motorway. It was all 50 apart from that.

I mean common sense says stick to 50, clearly that’s what’s intended.

However from a legal standpoint any ticket you get for exceeding the 50 limit would be contestable due to the conflicting information. Legally the speed limit is what the last sign displayed, so it went from 50 to 60 to 70, and isn’t 50 again until after the next sign.

And just before the end of the clip, there was still a temp 50 one on the slip lane. That said, it doesn’t seem to be a real problem. Note that the HoC says that when variable speed limit is operational below the normal limit, it is OK to pass on either side as well, and stay in lane at whatever speed. E.g. if the gantry value is 50, and the lane to your right is even slower, you do not have to slow down to the same speed as them, as long as you are less than or equal to the maximum (taking account of your cars’s accuracy; mine displays 53 for real 50 and so on).

Me and my dad encountered this. It said 50 constantly on the electronic signs. We didn't spot any of the metal ones. Everyone was doing 70 and my dad was like, "It says 50, so I'm doing 50." We wondered if they'd just accidentally left the sign running because the traffic wasn't backed up or anything, no road works or crash.

As long as you have a camera to prove it, and you don't mind spending a day in court to give evidence...
The speed limit is whatever the sign that you just past says it is. 50mph then 60mph then the slip road changes back to 50mph and then the motorway changes to national speed limit. Theres probably another 50mph sign just round the corner, which would change it back to 50mph.
