The instating of no fault divorce was fought for by women with blood, bruises, and tears. Previously if a man was unfaithful or abusive, you would need concrete evidence (that was admissable in court) and would be fighting the judge's bias on whatever line you had to meet.
No-fault divorce ensures that you cannot be prevented from escaping a bad situation if you cannot prove it or are not believed.
Its not an issue of freedom, its an issue of safety.
If you disagree, then imagine a system that solves this issue but isnt no-fault.
Perhaps if a spouse testifies to something like being hit, but has no proof, they are always allowed to divorce without exception. Its just that their ex-spouse is not prosecuted for assault because theres no proof.
Surprise! You've re-invemted no-fault divorce!
It is the only solution to the problem of abusive partners that hide it well.
