Which way do you think is better?

There are two methods for splitting up your assets if you get divorced.

This is determined by what state you live in.

In “Common Law” states the judge can consider a wide range of things. Such as each spouses earning ability, how long you were married and how much each of you contributed to building your household net worth.

In “Community Property” states, the property, money and assets acquired during the marriage are generally divided equally between both parties.
