En materia fiscal, la Ley del Impuesto sobre la Renta (LISR) clasifica a las Personas Morales en dos grupos:
- Personas Morales con fines lucrativos (Título II. Régimen General de Personas Morales)
- Personas Morales sin fines de lucro (Título III. Régimen de Personas Morales con Fines no Lucrativos).
La diferencia entre ambos régimenes es que en el Régimen General de Personas Morales eres contribuyente para efectos de ISR (O sea pagas ISR)
En cambio, en Régimen de Personas con fines no lucrativos, tienes una carga tributaria inferior ya que no tributas ISR por las actividades listadas en tu objetos social; aquellas listadas en tu acta constitutiva
y... tienes la posibilidad de convertirte en donataria autorizada.
Lo que te permitirá emitir comprobantes de donativos deducibles de ISR para el donante.
