Escalator is a public use device. If it canā€™t reasonably accommodate the public then the fault is on the party that owns the escalator. The defendant of that case is weak sauce at best and trying to deflect blame and pull a fast one over the jury at worst.

Escalators are one of the most dangerous conveniences ever made. They also attract kids to them like a magnet. These things can snag anything you are wearing and cause serious damage to you. Few realize how much peril they are when riding on one. The CDC says 17000 people are seriously injured on escalators every year.

If there's a specific shoe that makes a floor/escalator/whatever dangerous, the duty is on them to warn people about that, not on people who have no idea about the danger not to wear a certain kind of shoe. I'm amazed that even needs to be said.

According to the CDC, 20 people in the US are killed on escalators per year and 17,000 are injured each year. By comparison elevators kill 14 people per year, but 70% of those are people who are repairing or installing elevators, and in most of those cases it's by unlicensed repairmen. On a per hour basis, evaluators are probably the safest form of transportation ever created, as compared to any other form of transportation, including walking. There are thousands of people killed each year by walking, most being hit by cars.
