From a Trademark Lawyers take, here's a few things Jools can to today:

1. File a trademark application - yes, it seems counter-intuitive, but if they file a trademark application WHILE challenging the first applicant, they will be second in line to receive the registation when the first one is cancelled.
.
2. Determine if the pre-filed application is intent to use or current use. If intent to use, Jools can establish common law priority for the "Very Demure Very Mindful" brand if they can establish they used it first.
.
3. Send a cease and desist. This is the most sure fire way to make a record putting the potential infringer on notice that you're not playing about your rights.
