经审理查明：1999年至2023年，被告人李东利用担任神华准格尔煤炭公司党委副书记、经理，准格尔能源公司党委副书记、董事长，神华集团副总工程师、党组成员、副总经理，国家能源集团党组成员、副总经理等职务上的便利，为有关单位和个人在产品销售、煤炭采购、企业经营、职务调整等事项上提供帮助，直接或通过他人非法收受有关单位和个人给予的财物，共计折合人民币1.08亿余元，其中部分未实际取得。
宜春市中级人民法院认为，被告人李东的行为构成受贿罪，受贿数额特别巨大，应依法惩处。鉴于李东部分受贿犯罪系未遂，归案后如实供述全部罪行，认罪悔罪，积极退赃，涉案赃款赃物已全部追缴到案，具有法定、酌定从轻情节，依法可以对其从轻处罚。法庭遂作出上述判决。
