Cenk saying if you make a harsher punishment you get less of a crime and a lesser punishment gets you more of a crime is not actually human nature. That's assuming people are reasoning when they commit crimes. Human nature doesn't work that way.
The certainty of being caught vastly outweighs the punishment. You need people to believe they will be caught. There are also crimes of passion where people are not rational while committing the crimes.

punishment prevents some crime... UNTIL A CERTAIN POINT. and that point is reached much, much faster than most people think. a year of prison sentence is enough to deter the vast majority of people from almost any crime. smaller crimes have smaller punishments necessary.
of course, this doesn't work for some people. but for those people NO amount of punishment would deter them.
draconian punishments are not an effective tool to prevent crimes. the punishments in the US are WAY past the point of deterrence.
also punishment has absolutely zero effect on recidivism.
