Police looking in a window without a warrant could violate privacy laws, but if what they view is already visible to the naked eye from a public place, then using binoculars to see it would likely be allowed without a warrant.
A handful of courts have held that the use of night vision goggles does not constitute a “search” under the Fourth Amendment and therefore no warrant is needed.
