I live in New York and if you are seen drinking alcohol with the ignition on it’s considered DWI. I may be wrong but I think it’s also illegal to drink while your keys are in the ignition even if the key is in the off position of the ignition. Drinking in a car has never been a good idea so don’t take chances.

This has to be the only judge that would stick up for the defendant like that. I known someone who got convicted with dwi while sleeping in the back seat of their car. Since the keys were in the ignition, they said that was proof of driving. Even though they were sleeping it off.

This is the definition of innocent until proven guilty (purely the states responsibility to prove ) ie this is how every judge should operate especially when a defendant has a public defender or cant afford a high end attorney. Hes outstanding but also this should be the norm, i would rather have a guilty man walk free than an innocent man in jail.

I remember a guy that caught a dui cause he had his car running for the heater while he slept it off…he got dropped off at his car after a night out…he said the cops told him that he had the intent to drive cause his keys were in the ignition. Of course he busted for dui…well cause it was California to.

I watched this guy let an illegal alien go without jail time on her THIRD DUI so she could avoid getting deported. This guy is what is wrong with our justice system. We need judges tough on criminals, not giving them more chances to hurt the people that respect and honor the law. I would love to see his record on DUI cases based on race.
