It wasn't an accident, but I was in a parking lot when I saw a lady back up and hit a car.
She knew she damaged the car because she got out and looked at the damage. While she was looking at the damage she also looked around to see if anybody had seen it. I was standing there staring right at her!
She simply got back in her car and drove by me on the way out of the parking lot.
I made sure she saw me holding my phone recording her so she knew she wasn't going to get away with it.
But she wasn't too smart and drove away. I actually waited there until the owner of the damaged car came out and gave them my information.
A few days later I got a call from an insurance company asking me to explain what happened.
I believe they mailed me a letter to write it down and sign it which I did.
That was all I had to do. This is years ago I never heard anything after that so I'm guessing the case was cut and dry after that.
I don't feel bad because I gave her the chance to do the right thing by letting her know I was recording her.

"Subpoena" is Latin for "under penalty". If he refused to turn up after being served with it, I believe that falls under "contempt of Court" and that witness could get locked up for around 3 days. I used to think that legal professionals used Latin as a way of making the process even more difficult to understand, so that people would feel obliged to hire a lawyer. It's not that (at least not just that) it's because Latin is a dead language, so its meanings never change (unlike a living language, which is fluid and the meanings of words change constantly) so it's easier to be more precise ans unambiguous when using these Latin terms, because their meanings are set in stone and never change.

in germany you have to witness if you saw something, everytime unless its a family member
even if the police know nothing about it, if you dont say something you will be charged with some sort of bystander crime IF they find it out and can prove you saw it and knew what happened (nearly impossible)

Witnessed a car accident one time during my break at work. Figured it was a good way to get out of work and still get paid. Fast forward a few months, subpoena to go to court. Spent all day there, at the last minute lawyer tells me they don't want my testimony. Never Again. Especially for a fender bender.

Lawyers can usually pay a witness for their time spent testifying and traveling to do so. In fact in a federal case, lawyers are required to pay witnesses (itās a minimum amount that includes a calculation for distance traveled, but you can pay more depending on the witness).
